Be Ready to Assume or Transfer Legal Commitments

Legal commitments such as licenses, permits or contracts can help or hurt the sale of a business.

Either way, the seller must understand the process to transfer or assume these commitments. And this process takes time and energy – and it can slow down or even halt the sale, especially if government agencies are involved.

Identify these commitments in advance and be prepared to take the steps necessary (possibly using an experienced attorney) and advise buyers of what steps they must take.
